Conflicto de competencia suscitado entre el Juzgado Cincuenta y Siete Administrativo del Circuito Judicial de Bogotá y el Juzgado Promiscuo Municipal de Guacarí (Valle).
La controversia entre los precitados despachos tuvo su origen en las diferentes interpretaciones del factor territorial.
Ambos juzgados presentaron una serie de argumentos relacionados con el lugar donde se produjo y tuvo sus efectos la vulneración de derechos alegada por la parte demandante.
La Corte atribuyó el conocimiento del asunto al Juzgado Promiscuo Municipal de Guacarí, por ser la autoridad con competencia territorial para definir la solicitud de amparo, sin otorgar prevalencia al criterio a prevención, en atención a la información contenida en el expediente.

- Primero. DEJAR SIN EFECTOS el auto proferido el 18 de enero de 2022 por el Juzgado Promiscuo Municipal de Guacarí, Valle del Cauca, en el proceso de tutela promovido por Fernando Ochoa Hernández.
- Segundo. REMITIR el expediente ICC-4139 al Juzgado Promiscuo Municipal de Guacarí, Valle del Cauca, para que, de manera inmediata, tramite y adopte la decisión a que haya lugar.
- Tercero. Por la Secretaría General de esta corporación, COMUNICAR la presente decisión a la parte demandante y al Juzgado Cincuenta y Siete Administrativo del Circuito Judicial de Bogotá.
